Agenda for 23 August 2017 Joint Sully District Land Use and Transportation Meeting

1. The Sully District Joint Land Use and Transportation Committee will meet at 7:00 p.m. on 23 August 2017 in the Sully District Governmental Center Rear Meeting Room, 4900 Stonecroft Boulevard, Chantilly, VA, 20151. This meeting is on the fourth Wednesday of the month with participation by members of both the Land Use and Transportation committees of the SDCCA and WFCCA. The meeting will be followed by a SDCCA board meeting. The meeting will be canceled if Fairfax County Schools or after school activities are canceled due to adverse weather the day of the meeting.

5. The Sully District Council membership does not meet during the summer months
   • The next meeting is scheduled for Wednesday, 27 September 2017. Sully Supervisor Kathy Smith will present the State of Sully
   • The Sully District Council Board will meet after the July Joint Sully Land Use and Transportation Committee to plan the membership topics for the remainder of 2017 and the beginning of 2018. SDC members are welcome to attend.

6. Land Use and Transportation Committee:
• In light of the recent amendment to the Code of Virginia, the county has provided us with a statement be to read when our land use committee meets with a prospective applicant for a rezoning or proffer condition amendment (PCA) for new residential development and/or new residential use in areas of the County that are not exempt from Virginia Code Section 15.2-2303.4. It is recommended that if our committee is meeting with more than one applicant to read this statement for each rezoning/PCA.
• All times estimates are provided as a courtesy, presentations will start after the completion of the proceeding presentation, however long it takes. Recommend that presenters be ready at least 30 minutes prior to their scheduled time.
• Prospective presenters are requested to register on the Land Use and Transportation Committee Presentation Registration Form as a condition of their presentation.
1. 7:00 -- SE2017-SU-020
• Proponent: Frank Stearns, Donohue & Stearns, PLC
• Action: Relocate the site on the parcel
• Location: 6309T Bull Run Post Office Road
• From the On-line Land Use and Transportation Committee Presentation Registration Form:
• The above site was approved for a 150' monopole in fall of 2014. Due to change in plans of the underlying land owner the site had to be relocated on the parcel and this resulted in a need for SE and substantial delay. Milestone Verizon have filed SE application and has the number designated above. Supervisor Smith has placed this on expedited review and hopefully a hearing will be set for later this year. In light of expeditious review schedule I am reaching out now to see if Sully Land Use Committee wants to hear this again. You may recall this is deep into the woods adjacent to public land on the NOVEC Pleasant Valley Substation. There was no opposition and staff recommended approval. The only change is where on the parcel it will be located.
• Here is reduced version of what was filed with County. This gives most of information your committee is interested in without all the other material. Staff agreed to allow us to use the photo sims from 2014 since the site only moved 450' to the South East.
2. 7:30 -- RZ 2016-SU-015 Old Lee Rd car storage and service center (return visit)
• Proponent: Keith Martin
• Action: RZ 2016-SU-015 to rezone TM 43-2 ((1)) 2 from I-3 to I-5
• Location: Old Lee Road next to the School Board bus lot

  • Description: RZ 2016-SU-015 to rezone TM 43-2 ((1)) 2 from I-3 to I-5 to permit a New Vehicle Storage use on the 5 acre property.
This was heard by the committee in October 2016 and March this year, see the March minutes for more detail. At that time the SDCCA had no objection but indicated that if staff report had negative comments they were to return to address them.

3. 8:00 -- zMOD outreach
• Proponent: Deputy Zoning Administrator Drew Hushour and Zoning Administrator Leslie Johnson, Fairfax County Department of Planning and Zoning, Zoning Administration Division (ZAD)
• Action: Modernization of Fairfax County's Zoning Ordinance
• Location: Countywide
• Fairfax County launched a major initiative to modernize its zoning ordinance that was first established 40 years ago. Dubbed "zMod", the effort will help the county carry out its strategic plan to grow and diversify its economy. The modernization plan was presented on Tuesday, March 28, at the Fairfax County Board of Supervisors' Development Process Committee.
  "We want to be sure that our ordinance is forward thinking in terms of being able to accommodate uses that we don't know about today that will be here in the future," said Barbara Byron, director of the Office of Community Revitalization, who will lead the project in collaboration with the Department of Planning and Zoning.  zMod will work in tandem with the county's existing process for amending its zoning laws by prioritizing proposed changes of county-wide significance.
  The first phase focuses on three key areas:
  • Prioritizing key zoning ordinance amendments for updates.
  • Reformatting and restructuring the ordinance to make it more user friendly, such as including more charts, tables and links.
  • Improving the county's overall process for how the zoning ordinance is updated.
  Three amendments will be prioritized:
  • Updating minor modification provisions to make them more flexible, allowing the county to more efficiently approve minor changes to proffers and development conditions.
  • Updating the regulations for planned development housing districts.
  • Reviewing use definitions to create more generic categories to accommodate current, emerging and future uses, like makerspaces, urban farming, and live-work units.
  To help implement zMod, the county plans to hire consultant services, and the county executive's proposed FY 18 budget includes two new staff positions to work on the project.

4. 8:30 -- Dulles Discovery South Retail

• Action: Dulles Discovery South Retail Proffered Condition Amendment (PCA) 2003-SU-035-03 and Special Exception 2017-SU-015
• Location: 3456 Historic Sully Way, Oak Hill

• Description: DD South Retail LC (the "Applicant"), a related entity of The Peterson Companies, submitted a Proffered Condition Amendment/Conceptual Development Plan Amendment/Final Development Plan Amendment and a companion Special Exception (the "Applications") on approximately 1.10 acres identified as Fairfax County Tax Map Parcel 34-2-((1))-1D (the "Property") which is zoned to the "Planned Development Commercial" ("PDC") and Water Supply ("WS") Districts. The Property is located within the Dulles Discovery South Retail ("DDS Retail") land bay which consists of approximately 6.36 acres which lies between Air and Space Museum Parkway, Historic Sully Way, and Route 28. A small portion of the Property is located within the Sully Historic Overlay District ("SHOD").
  The Board approved PCA/CDPA/FDPA 2003-SU-035-02, concurrent with SE 2013-SU-017 (the "2014 PCA/SE") to permit the development of a child care center (Primrose Schools), drive-in bank, fast food restaurant with drive-through (Chick-fil-A), and a service station/quick service food store (Wawa). With the exception of the drive-in bank, all of the uses have been constructed and are open to the public. To date, there has not been any interest from prospective purchasers/tenants for the drive-in bank. The existing condition of the Property is a vacant, graded pad site. In order to be able to respond to market demands, the Applicant is proposing two development options for the Property, in addition to the previously approved drive-in bank. Specifically, an option for either a retail/commercial use as permitted in the PDC District such as an urgent care facility; or an alternate option for a fast food restaurant with drive-through. With either option, primary access to the Property will continue to be from the existing Historic Sully Way across from the main entrance to the DDS secure office campus.
5. 9:00 -- Dulles Discovery South Secure Office Campus

• Location: The Property is located south of Air and Space Museum Parkway, between Sully Road (Route 28) and Centreville Road.

• Description: DD South 5 LC (the "Applicant"), a related entity of the Peterson Companies, submitted application RZ/FDP 2017-SU-011 (the "Application") for Dulles Discovery South, a secure office campus located south of Air and Space Museum Parkway, between Sully Road (Route 28) and Centreville Road. The Application is filed on approximately 77.31 acres and identified as Tax Map Parcels 34 2 ((1)) 2C1, -2D1, -2E, -3C1 ("DDS") and Tax Map Parcel 34-2-((1))-6 ("Parcel 6"). DDS is zoned to the "Planned Development Commercial" ("PDC") and Water Supply ("WS") Districts and consists of approximately 74.24 acres. A portion of DDS is located within the Sully Historic Overlay District ("SHOD"). The purpose of the Application is to relocate a previously approved office building ("DD5") and its related parking structure from inside of the SHOD to an area outside of the SHOD and immediately adjacent to office buildings DD3 (existing) and DD4 (under construction) to create a more cohesive campus.
  The Application also includes the addition of Parcel 6, zoned I-5, which consists of approximately 3 acres and is located along Centreville Road across from residential uses. The I-5 parcel is located within the secure campus and is currently developed with surface parking. Parcel 6 is proposed to be rezoned to the PDC District, consistent with the DDS campus, and the parking structure is to be located on it. The addition of the by-right I-5 parcel and its rezoning to the PDC District eliminates the potential for future industrial uses along Centreville Road; results in a more cohesive design for the Property with the continuation of the significant landscape buffer adjacent to nearby residential communities; spreads the FAR of the I-5 parcel imperceptibly over the approx. 77.31-acre campus rather than developing it all on the 3 acres fronting Centreville Road; and furthers the vision for the Dulles Suburban Center.
6. 9:30 -- Taco Bell Drive-thru in McLearen Road Shopping Center

• Action: Special Exception for a Fast Food Drive-thru application
• Location: Corner of McLearen Road and Centreville Road.

There is not a colored version of the proposal yet, but attached are two sheets from the plat showing the layout and location. The second attachment shows the building details.

• Arden Courts Memory Care Facility
• This application was heard and approved at the July Joint Committee meeting where by a vote of the respective memberships the SDCCA had no objection, while WFCCA support was conditioned on their receipt of the requested contour map.
• The contour map was subsequently furnished with the following comments: When we presented our application at the Sully Land Use Committee meeting on July 26, 2017, the committee asked if we could provide some cross-section elevations to demonstrate the view of the proposed Arden Courts development from the perspective of the townhomes directly to the south of the site. Our civil engineers prepared the attached cross-section elevations for the committee's review and consideration. Please let me know if the committee would like any additional information.
